Impact Fee Credit Special Committee

Any member of the public that desires to be considered for appointment to serve on a proposed Impact Fee Credit Special Committee must submit an interest form by 5 p.m. on Tuesday, January 8, 2019.  The Special Committee Interest Form is available and can be submitted via the City's website,, or can be obtained from the City Manager's Office at City Hall, 3200 Civic Center Circle. The paper interest form should be returned to the City Manager’s Office.

At the January 9, 2019 meeting of the Governing Body, Mayor Gregg Hull and District 6 City Councilor David Bency are introducing a Resolution, if approved by the Governing Body, which will form an Impact Fee Credit Special Committee.  The committee will be tasked with fact-finding pertaining to:

1. Impact Fee Credit eligibility for system improvements and the applicability of proportionate share, interest and time value of money factors;
2. Timelines for using Impact Fee Credits including Credits associated with Development Agreements;
3.Approval process for issuing Impact Fee Credits;
4.Geographic boundary limitations for using Impact Fee Credits including whether existing Development Agreement boundaries should be enforced, modified or voided;
5.Term limitations for Development Agreements including the benefits and process for extension of existing term limits; and
6.Comparison of the method of Impact Fee calculation to the method of Impact Fee Credit calculation.

The committee must provide a minimum of two recommendations based on their fact-finding to the Governing Body. The due date for the recommendations will be April 9, 2019.

If the Governing Body approves the formation of the committee at its January 9 meeting, pursuant to the Governing Body’s Rules of Procedure, the committee’s membership will be identified and confirmed immediately following creation. The committee would consist of between four to seven members that may be comprised of Governing Body members (three maximum), members of the public (two maximum) who have submitted an interest form and have been appointed by the City Manager, and City staff designated by the City Manager.

The City of Rio Rancho imposes Impact Fees pursuant to State law. Impact Fees are a charge paid by new development to aid the City with paying for the costs of capital improvements or facility expansions necessitated by and attributable to the new development.  The City also provides Impact Fee Credits if the development pays for more improvements than are necessary to serve their development. These credits can be applied to future development when Impact Fees are required.
